: hey guys, first off thanks for all the support. your advice is very helpful in getting through this ordeal. i didn't get the official adjuster's quote yet but i got a rough estimate from my body shop: $5,000-$7,000. : i have so many questions now. please try to answer one or two if not all. it would really help: : 1. is it my right to choose any shop i want to? can the opposing insurance co. insist i use their's or is it legally my right to refuse and use who i am comfortable with? Yes, you have the rights to choose the body shop. Insurance will most likely choose the least expensive estimates. : 2. if the car is totalled, would i get the full blue book value of my car? currently worth approx. $11.5 if not, what price would they give me? Insurance will give you a blue book value of your car, however, to contest a high value than the blue book, you need to provide them with a list of how much is the car going for at the market. search for the car/year and show the market price. : 3. is it my right to decide if i want the car totalled? say the damage is $6000, but i don't want to keep the car anymore because it will never be the same. is it my right to tell them i want the money instead? : now for some serious q's: : 1. is this a guaranteed victory for me if i do decide to enter into a lawsuit in rearend collision cases? i did not read your post but if you didnt get any citations from the accident and the other person that hits you received a citation, then youre most likely have a case. i would consult a lawyer first and then ask if you have any case. : 2. how long would the entire process (weeks, months, years) take for settlement? it all depends of how the lawyer prolong the case. the longer it takes, the more $$$ you could expect. lawyers would probably recommend you to go to theraphy for any injuries suffered from the accident. again, the longer you stays in theraphy, more $$$, as your injuries reflects the pain and suffering. : 3. how do they calculate monetary compensation? in all seriousness, my neck is sore. loss of wages, any hospital bills, and dont forget the lawyers fee which is more like 33.33%/66.66%. : 4. any advice you can give me (recommendations for good lawyers in ny, etc). ron barry? lol, j/k.. anyone with car accident will do. : according to my body shop, the opposing insurance company must pay for 100% of the damages to fix up my car with new parts. they told me they can take care of everything if i just give them the police report and the insurance info. good idea? also, what if my body shop quotes $6000 to fix, but the insurance adjuster thinks its too high? is it legally binding for them to pay whatever my body shop quotes because it was a rear end collision?
